Practitioner Course – Terms and Conditions

 

You should read these Terms before placing an order as they contain important information.

 

We have tried to state the Terms as clearly as possible, however, if you have any queries at all about the Terms, please do not hesitate to contact us.

 

1. Introduction

These terms and conditions apply to all practitioner courses operated by Kids Back 2 Sport (“Course”). Please read these terms carefully before you register for a Course. By registering for a Course, you accept these terms and conditions and agree to abide by and be legally bound by them. If you do not agree to these terms and conditions of use, please refrain from registering for a Course. These terms and conditions also incorporate our website Terms of Use which also apply to our Courses.  

The practitioner courses are operated by Kids Back 2 Sport Limited (“Kids Back 2 Sport”, “we”, “us”, or “our”), a company registered in England and Wales (company number 14832641) and having its registered office at Hunger Hill Barn, Hunger Hill Lane, Over Peover, Knutsford, Cheshire, WA16 8UD. 

2. Course Fees, Cancellations, and Refunds

Course fees will be detailed when you register for a Course. Participation in a Course is subject to our receipt of the full course fees. It is the responsibility of the person making the booking to ensure that the selected courses are appropriate for their needs.

Courses and study materials are single use only and log in details should not be shared. Evidence of multiple students sharing an account could render the course access being revoked. 

All cancellations must be made to us in writing.   

For cancellations made less than 2 weeks before an in person Course, we will retain the full cost of the Course. No refunds will be given for online courses. 

In the unlikely event that we have to cancel a Course or event, you will be refunded in full for the cost of the Course only. Unless the course or event is cancelled by us, no refunds will be granted for failure to attend because of reasons beyond our control. 

3. Course Content and Disclaimer

Each Course and the information contained in a Course is designed as general educational material. The authors endeavour to maintain each Course with up to date and relevant information, but no responsibility can be taken for how that information is used, nor does it represent any guarantee of suitability for use. Each child is different, so the information should not be taken as a recommendation for specific medical diagnosis or treatment. Any use, implementation and/or reliance on the information contained on a Course remains your responsibility and you do so at your own risk. We accept no responsibility for your use of the materials in providing treatment or advice and you indemnify us for any losses, damages, liabilities, costs or expenses that we may suffer or incur due to your actions. 

We reserve the right to amend our Courses and their content in our sole discretion. 

4. Intellectual Property

Any Course content and the names, images and logos identifying Kids Back 2 Sport or third parties and their products and services are owned by us or the third party and are subject to copyright, design rights and trademarks of Kids Back 2 Sport and/or third parties. Save as expressly stated in paragraph 5 below, nothing contained in these terms and conditions shall be construed as conferring by 

 

 

 

 

implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of Kids Back 2 Sport or any other third party. 

You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use our Course content save as expressly permitted by us. You also agree not to adapt, alter or create a derivative work from any of our Course content except for your own personal,

non-commercial use. Subject to an express permissions contained in these terms and conditions; any other use of our Course content requires the prior written permission of Kids Back 2 Sport. 

5. Completing the Course and use of the K2B logo  

In order to complete a Course, you will be required to pass a test and be issued with an official course completion certificate by us. Issuing of a course completion certificate is at the sole discretion of Kids Back 2 Sport and you will not be deemed to have completed a Course until you have received this certificate. Once you have completed a Course and received this certificate, you will be eligible to apply for a listing on the Kids Back 2 Sport directory. 

6. Eligibility for a listing on the Kids Back 2 Sport directory

To be eligible for a listing on the Kids Back 2 Sport directory, you must be a health professional who holds a degree level qualification in Physiotherapy, Sports Therapy, Sports Rehabilitation, Osteopathy, or Chiropractor and registered with your Professional Body and where applicable to the HCPC. You will have professional indemnity insurance in accordance with your professional body recommendations.  

7. Use of Kids Back 2 Sport logos

Once a clinician is accepted for a listing on the Kids Back 2 Sport directory, we want you to be able to use the official Kids Back 2 Sport logos that we make available to you (the “KB2S Logos”) to set you apart from the competition and promote yourself to potential clients. We grant you a nonexclusive, non-transferable, revocable licence to use the KB2S Logos solely to promote your credentials to clients in accordance with these Course terms and conditions and the following requirements: 

•        You shall only use the KB2S Logos in the forms and designations provided by us. You are not granted any rights to use the name Kids Back 2 Sport other than as expressly authorised in these terms. The intent of allowing you to use the KB2S Logos is solely to promote your Kids Back 2 Sport certified credentials to your clients. 

•        You shall not use any of the logos in connection with a certification level or Course that you have not completed.

•        You must use the KB2S Logos in a manner consistent with the good name, goodwill, reputation and image of Kids Back 2 Sport and shall not use or permit the use of the KB2S Logos in any manner contrary to public morals or which is considered deceptive or misleading or which compromises or reflects unfavourably upon the good name, reputation, and image of Kids Back 2 Sport. 

•        You shall take all necessary actions to ensure that all services that you promote, advertise, or provide in conjunction with the KB2S Logos shall be of the highest service performance standards and will be in accordance with the techniques and methods taught in the completed Course. 

 

 

 

 

 

 

•        You shall not adopt or begin to use any trademark, symbol, mark, or designation which in Kids Back 2 Sport's opinion includes or is confusingly similar to the KB2S Logos or unfairly competes with the KB2S Logos. 

•        You acknowledge and recognise the great value of the goodwill associated with and attached to the KB2S Logos and that such goodwill belongs exclusively to Kids Back 2 Sport. Any and all rights and opportunities not expressly granted to you under these terms are hereby reserved by and to Kids Back 2 Sport in accordance with paragraph 4 above. If at any time you become aware of any goodwill or proprietary right in relation to our KB2S Logos vesting in you, you shall immediately assign, or procure the assignment of, such goodwill and/or right(s) to us. 

 

 

Without prejudice to any other rights and/or remedies available to us in these terms and conditions or under applicable law, we reserve the right to terminate your licence to use the KB2S Logos with immediate effect by giving you written notice if, in our sole discretion, we are of the view that: (i) you are in breach of any of these Course terms and conditions; and/or (ii) you have acted in away that is non-representative of our brand or damages the goodwill or reputation of Kids Back 2 Sport.  

By using the KB2S Logos, you indemnify us for any losses, damages, liabilities, costs or expenses that we may suffer or incur due to your actions. 

8. Limitation of Liability  

A Course’s content is provided “as is” and on an “is available” basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, noninfringement, compatibility, security and accuracy. Any reliance you place on such information is therefore strictly at your own risk. 

UNDER NO CIRCUMSTANCES WILL KIDS BACK 2 SPORT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, OR OTHER LOSSES (WHETHER SUCH LOSSES AREFORESEEN, FORESEEABLE, KNOWN OR OTHERWISE) ARISING FROM A COURSE OR ITS CONTENT REGARDLESS OF THE FORM OF ACTION. NOTHING WILL EXCLUDE OUR LIABILITY FOR DEATH OR PERSONAL INJURY AS A RESULT OF OUR NEGLIGENCE OR FRAUD OR FRAUDULENT MISREPRESENTATION OR FOR ANY OTHER LIABILITY WHICH CANNOT BE EXCLUDED BY LAW. 

7. General

These terms and conditions incorporate by reference any notices contained in our Courses and constitute the entire agreement with respect to your participation in a Course. 

We reserve the right to change our Courses and amend these terms and conditions at any time. We will notify you of any material changes to the Courses and these terms and conditions. 

If any provisions of these terms and conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions. In the event of any conflict between these terms and the Terms of Use, these terms shall prevail. 

These terms and conditions and your use of the Website shall be governed by and construed exclusively in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
